Short-term rental agreement

Terms and Conditions

1. Property: The property is located in the Avalon complex.
The property is furnished and includes a fully equipped kitchen with refrigerator, freezer, oven, cooking range, microwave, dishwasher, toaster, coffee maker, cookware, dishes, glasses, utensils, linens and towels. The property also includes a full-size washer and dryer, iron, ironing board, hair dryer, beach chairs, cooler and umbrella for the beach.

2. Rental Party: Upon completion of booking, we require the following information:
– Name and date of birth of every person that will stay in the condo
– Full home address and phone number
– A photo or scan of a state/government-issued ID (ex: driver’s license, passport, national ID or visa)
– Emergency contact (name, relationship, phone number) – a trusted contact we can alert in case of an urgent situation.

3. Maximum Occupancy (Sleeps up to 6): The maximum number of guests without any additional charge is limited to 4 (CHILDREN INCLUDED), however, up to 2 more guests can be accepted with an additional charge to the quoted rate of either US$ 15 per additional guest per night or a fixed amount determined by the Owner for a particularly long stay.

4. Age Criteria: The Guest making the reservation must be 25 years of age or older and must occupy the rental property for the entire term of stay booked for the reservation. Children are welcome when traveling with a parent or guardian.

5. Check-in time is after 4 P.M. local time and Checkout is 11 A.M. local time. No early check-ins or late checkouts are permitted unless agreed with the Owner.

6. Rental Rules: The Guest agrees to the Rental Rules (a copy is supplied after the booking of your vacation property) at all times while on the property and all members of the rental party, including anyone else the Guest permits on the property, shall respect these rules at all times while on the property.

7. Access: The Guest shall allow the Owner access to the property for inspection and repairing purposes. The Owner shall exercise this right of access in a reasonable manner.

8. Rental Rate: The Guest agrees to pay the total rental fee, as displayed on the rental quote, within the due dates as set out on the booking confirmation. Rates are subject to change until rental dates are confirmed.
A deposit of 50% is due at the time of booking. Final and full payment is due within 60 days of the Check-in Date.

9. Inclusive Fees: Rates include a one-time linen-towel setup. Amenities fees are included in the rental rate.
a) Swimming Pool. The use of the swimming pool is limited to the Owners and their Guests. All bathers are required to acknowledge the posted complex regulations.
b) Gym.

10. Refundable damage deposit: A $250 US damage/security deposit is required. This deposit is fully refundable once the Guest has checked out and the condo has been inspected.
The deposit is made for security reasons and shall be refunded within 7-10 days of the Checkout Date provided no deductions are made due to:
a. damage the condo or its contents;
b. charges incurred due to contraband, pets or collection of rents or services rendered during the stay;
c. debris, rubbish and discards left inside the condo;
d. soiled dishes left in the sink or dishwasher;
e. lost keys;
f. damaged, lost or stolen linens;
g. smoke inside the condo;
h. parking passes being lost or not left inside the condo upon departure;
i. unapproved early check-in or late check-out;
j. violation of any of the resort’s rules that incur fines or penalties;
k. trash not properly disposed of. (All trash must be taken to the dumpsters located to the north end of the condominium complex. No trash is to be left outside doors or on balconies at any time. A fine of $50, per day, is strictly enforced if trash is left outside the door or on the balcony.)
If the premises appear dirty or damaged upon Check-in, the Guest shall inform the Owner immediately.

11. Payment: It is preferable that payments are either made online with a debit or credit card, or in the form of bank money orders, cashier’s checks or personal checks payable and mailed to the address indicated in the email coming with the final booking confirmation. Checks must arrive before the final payment’s due date.
The name provided with all documents must match; name of lead guest on reservation making payment, name on credit/debit card or checks used, name on photo ID.

12. Cancellation Policy: The Guest may cancel their booking at any time before the day on which the final payment is due. In the event that the Guest exercises their right to cancel, the deposit will be:
a) non-refundable if cancellation is made 60 days or less prior to the Check-in Date.
b) fully refunded if cancellation is made more than 60 days prior to the Check-in Date.
Note: The guest will be refunded for the amount actually paid, thus excluding the value of any coupon or discount. However, if the guest paid with a credit card or through PayPal, 3% fees will be deducted. All payments from non-US cards will be deducted an additional 1% fee.

13. Hurricane or Storm Policy: No refunds or reschedule bookings due to hurricane activity. If you are concerned about the possible interruption, cancellation or delayed travel due to tropical occurrences, you are strongly encouraged to purchase travel insurance.

14. Travel Insurance: We highly recommend you purchase travel insurance. If you wish to purchase travel insurance, go to InsureMyTrip.com for details and to purchase or any other company of your choice. If you pay with a credit card, some credit cards include travel insurance. Please verify with your credit card company.

15. Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in or may be evicted.

16. Smoking: This is a smoke free, drug free and vaping free home.

17. Parking/ Parking passes: Parking is limited to two (2) vehicles. Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner. No Commercial vehicles permitted to park overnight, anywhere on the Avalon property.
ONE Parking pass is located inside the unit. Renters must display parking pass on the rear view mirror at all times. Failure to display may result in towing of vehicle at renter’s expense. Leave the parking pass inside the unit upon departure. If you have two vehicles or there is no parking pass inside the unit at your arrival, first inform the owner and second write on a paper the unit number and place it on the dashboard until we provide another parking pass for you.

18. No daily housekeeping service: Daily housekeeping service is not included in the rental rate however, is available at an additional rate.

19. Self Catering: Our property is self catering accommodation. Please note that we provide complimentary starter soap, toilet paper, dishwasher detergent, laundry detergent and trash bags. Once these items are used, it is the Guest’s responsibility to replenish them.

Linens, bath and hand towels are included in the unit. We do not permit these to be taken out from the condo. Six (6) beach towels will be provided, however, these must be washed and placed back to their original place by the guest party prior its check-out in the event they are used.

20. Surveillance or recording devices on property: For everyone’s safety an outdoor surveillance camera is in place covering the front door.

21. Pets: Pets are NOT permitted in rental unit unless agreed with the owner.
21A. Exception: Pets are permitted in rental condo only with prior approval. $200 per pet fee applies. All pets must be leashed at all times. Pet owners are responsible for cleaning up of any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. All pets must be up to date on rabies vaccinations and all other vaccinations. Heartworm preventative is highly recommended. All pets are to be treated with Advantage or similar topical flea and tick repellent three (3) days prior to arrival. The condo owners assume no responsibility for illness or injury that may incur to pets while on the premises. Renters must RESPECT all complex pet rules including but not limited to cleaning up after your dog, not leaving dog unattended on leashes and curb barking.

22. The condo will be in clean and working condition. No compensations will be given for non-working items outside the owner’s control, including but not limited to power outages, cable TV outages, internet outages, etc. For items inside the owner’s control, the owners will make every attempt to rectify problems that may occur while you are in the condo. It is the renter’s responsibility to notify the owner immediately if there are any problems. No refunds or any other compensation will be given for the problems that the owner is able to rectify within a reasonable time frame.

23. Written Exceptions: Any exceptions to the above mentioned policies must be approved in writing in advance.

24. The condo is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. The Guest must ensure that children are supervised at all times. All children under the age of 18 years should not be left in the rental home un-supervised at any time during the rental period.

By accepting this reservation, it is agreed that all guest are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

I agree that all rental funds are non-refundable per cancellation policy above. I have read my rights to purchase travel insurance. I also agree damage charges can be charged to my credit card or my refundable deposit if damages are incurred during my stay.
